OVERVIEW
Welcome to wanakomeclothing.eu (the “Site”). The terms “we”, “us” and “our” refer to 9507-0595 QUÉBEC INC. (“Wanakome”). We operate this online store and provide related information, content, features, tools, products and services (the “Services”). The Services are powered by Shopify.
These Terms of Service (the “Terms”), together with the policies referenced herein (including our Privacy Policy and Refund/Returns Policy), describe your rights and responsibilities when using the Services. By visiting, accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
SECTION 1 – ACCESS AND ACCOUNT
You represent that you are at least the age of majority in your country of residence and that any minors using devices you own or manage do so with your consent. You may be asked to provide information (e.g., email, billing and shipping data). You warrant that all information you provide is true, current and complete and that you have the rights to provide it. You are responsible for safeguarding your account credentials and for all activity under your account. You may not transfer or assign your account.
SECTION 2 – OUR PRODUCTS
We aim to describe products accurately, but colors and appearance can vary by device and settings. Images are illustrative and not contractually binding. Product descriptions, availability and pricing may change at any time without notice; we may limit quantities for any person, region or jurisdiction.
SECTION 3 – ORDERS
When you place an order, you make an offer to purchase. We may accept or decline any order at our discretion. An order is accepted when we send an order confirmation email and process your payment. Please review your order carefully; cancellation requests may not be possible once accepted. If we do not accept or cancel an order, we will attempt to notify you using the contact details provided at checkout. Your purchases are subject to our Refund/Returns Policy.
You represent that your purchases are for personal/household use and not for commercial resale.
SECTION 4 – PRICES, VAT (IOSS) AND BILLING
Prices, discounts and promotions may change without notice. The price charged is the price in effect at the time of your order and appears on your confirmation email. Unless expressly stated, posted prices exclude shipping/handling (shown separately before checkout).
VAT & IOSS. Prices on this Site are shown in euros (€) and include VAT collected under the Import One-Stop Shop (IOSS) scheme. For customs purposes, we only accept orders up to an intrinsic value of €150 (excluding VAT) per shipment. Transport/insurance are excluded from the intrinsic value calculation when they are shown separately on the invoice.
You agree to provide current, complete and accurate purchase, payment and account information and to promptly update such information so we can complete your transactions and contact you as needed.
SECTION 5 – SHIPPING AND DELIVERY
Origin & exporter. Goods are exported and fulfilled from Canada by 9507-0595 QUÉBEC INC.
Carrier & timing. Orders are shipped via Chit Chats International Tracked with full tracking. Estimated delivery time: 7–27 business days. Estimates are not guarantees; delays may occur (e.g., carrier issues, peak periods, weather).
Taxes & duties. For orders with intrinsic value ≤ €150, VAT is prepaid under IOSS and no customs duties apply at delivery. If an order exceeds this limit, it will not be accepted.
Address accuracy. You are responsible for providing a complete and correct delivery address. Costs arising from address errors or failed delivery due to your act/omission may be charged to you.
Risk of loss. In accordance with EU consumer law, the risk of loss or damage passes to you only when you (or a third party indicated by you, other than the carrier) physically take possession of the goods.
SECTION 6 – RIGHT OF WITHDRAWAL (EU CONSUMERS)
If you are an EU consumer, you have a legal right to withdraw from your purchase within 14 days from the day you receive the goods, without giving any reason.
How to withdraw. Notify us of your decision by email to hello@wanakomeclothing.eu with your order number and items. You may use the model withdrawal form in Section 21, but it is not mandatory.
Returns. After notifying withdrawal, return the goods within 14 days to: Wanakome EU Returns – 555 Chabanel Ouest, Suite 803, Montréal, QC, H2N 2H8, Canada. Returned items must be new, unworn, unwashed, with original tags/packaging. Return shipping is at your expense. To avoid re-import duties, clearly mark the parcel: “Returned goods – no commercial value – customer return”. Any duties charged upon re-import will be deducted from your refund.
Refunds. We refund within 14 days of receiving the returned items or receiving proof of shipment (whichever is earlier), using the original payment method. We refund the initial standard delivery costs (not any express/extra options). We may withhold the refund until we receive the goods or proof of shipment, whichever is earlier.
SECTION 7 – DEFECTS AND LEGAL GUARANTEES
In addition to the withdrawal right, your purchase benefits from the EU legal guarantee of conformity (Directive (EU) 2019/771) and the guarantee against hidden defects, applicable under national law. If your item is non-conforming or defective, contact us at hello@wanakomeclothing.eu (photos may be requested). Where a defect is confirmed, we will provide an appropriate remedy (repair, replacement, price reduction or refund) and reimburse reasonable return shipping costs.
SECTION 8 – INTELLECTUAL PROPERTY
The Services (including trademarks, text, images, graphics, audio/video and their arrangement) are owned by Wanakome and/or its licensors and are protected by applicable intellectual property laws. You may use the Services for personal, non-commercial purposes only. Any reproduction, distribution, modification or derivative use without our prior written consent is prohibited.
SECTION 9 – OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available” without warranties and without liability. Your use of such tools is at your own risk and subject to third-party terms.
SECTION 10 – THIRD-PARTY LINKS
The Services may link to third-party sites or materials. We are not responsible for their content, policies or practices. Access and transactions with third parties are at your own risk.
SECTION 11 – RELATIONSHIP WITH SHOPIFY
The Services are powered by Shopify; however, all sales are between you and 9507-0595 QUÉBEC INC. Shopify is not responsible for your purchases or any related claims. You release Shopify and its affiliates from claims arising out of your transactions with us.
SECTION 12 – PRIVACY
Personal data are processed in accordance with our Privacy Policy and the GDPR. Data may be transferred to Canada, which is recognized by the European Commission as providing an adequate level of protection for personal data processed by private-sector organizations subject to Canadian privacy law (PIPEDA). SECTION 13 – FEEDBACK
If you submit reviews, ideas or feedback (“Feedback”), you grant us a worldwide, royalty-free license to use and display such Feedback to operate and improve the Services. You warrant you have the rights to provide the Feedback and that it complies with law and these Terms.
SECTION 14 – ERRORS, INACCURACIES AND OMISSIONS
Information on the Services may contain typographical errors or inaccuracies (including pricing, availability, shipping charges and transit times). We may correct or update information, or cancel orders, at any time without notice if information is inaccurate.
SECTION 15 – PROHIBITED USES
You may not use the Services for unlawful purposes or to violate laws/rights, transmit malware, spam, impersonate others, scrape or interfere with security or operation. We may suspend or terminate access for violations.
SECTION 16 – TERMINATION
We may terminate or suspend access to the Services at any time. Sections that by nature should survive (e.g., Intellectual Property, Liability, Data, Governing Law) shall survive termination.
SECTION 17 – DISCLAIMER OF WARRANTIES
Except as required by law or expressly stated, the Services and products are provided “as is” and “as available” without warranties of any kind. Your use is at your sole risk. Mandatory statutory rights of EU consumers remain unaffected.
SECTION 18 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, we shall not be liable for indirect, incidental, special or consequential damages, loss of profits, data or business interruption arising from your use of the Services or products. Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g., for death/personal injury caused by negligence, fraud, or your statutory consumer rights).
SECTION 19 – INDEMNIFICATION
You agree to indemnify and hold harmless 9507-0595 QUÉBEC INC., Shopify and their affiliates from claims arising out of your breach of these Terms or violation of law, to the extent permitted by applicable law.
SECTION 20 – SEVERABILITY; ENTIRE AGREEMENT
If any provision is unlawful or unenforceable, the remainder remains in force. These Terms and referenced policies constitute the entire agreement regarding the Services and supersede prior understandings.

SECTION 22 – GOVERNING LAW; CONSUMER RIGHTS; DISPUTE RESOLUTION
These Terms are governed by the laws of Québec, Canada, without prejudice to the mandatory consumer protection rights of your EU country of residence. For consumers in the EU, disputes may be brought before the courts of your domicile.
You may also use the EU Online Dispute Resolution (ODR) platform for cross-border disputes: ec.europa.eu/consumers/odr.
SECTION 23 – CHANGES TO THE TERMS
We may update these Terms from time to time. We will post changes on this page and, where required by law, notify you. Your continued use of the Services after the effective date constitutes acceptance.
