Terms and Conditions of Sale

Preamble

These Terms and Conditions of Sale (hereinafter the “Terms”) apply between:

(hereinafter “Wanakome” or “the Seller”)

and any natural person acting as a consumer making a purchase of Wanakome products on the website www.wanakomeclothing.fr (hereinafter “the Buyer”).

Placing an order on the website implies full and unreserved acceptance of these Terms, which the Buyer acknowledges having read and accepted.

1 – Purpose

These Terms define the rights and obligations of the parties in connection with the online sale of ready-to-wear products offered by Wanakome, from order placement to after-sales service, including payment and delivery.

2 – Identification of the Seller and Shipping

3 – Products

The products offered for sale are those described on the website at the time of the Buyer’s visit. Wanakome makes every effort to ensure the accuracy of descriptions, photographs and information. Minor variations (such as color or appearance) may occur without affecting the validity of the contract.

4 – Prices

  • Prices are displayed in euros (€), including all applicable taxes (VAT).
  • VAT applicable within the European Union is collected under the Import One-Stop Shop (IOSS) scheme in accordance with EU regulations.
  • Shipping fees are specified before order confirmation and are added to the product price.
  • For customs purposes, orders are limited to an intrinsic value of €150 (excluding VAT and separately stated shipping costs). No customs duties are payable upon delivery for such orders.
  • Wanakome may modify prices at any time; products are invoiced based on the rates in effect at the time of order confirmation.

5 – Orders

Placing an order constitutes acceptance of these Terms. The order becomes final once full payment has been made and the confirmation email has been sent. The Seller reserves the right to refuse or cancel any order that appears suspicious or irregular (e.g., attempted fraud, obvious error, payment issue) after informing the Buyer.

6 – Payment

Payment is made online by credit card (Visa, Mastercard, American Express) and/or any other method offered at checkout. Transactions are secured via the Shopify Payments platform. The Buyer guarantees that they have the necessary authorization to use the chosen payment method and that the provided information is accurate.

7 – Delivery

Products are shipped from Canada via Chit Chats International Tracked with full tracking. Estimated delivery time: 7–27 business days, depending on the destination. These timeframes are indicative; delays may occur (carrier issues, peak periods, weather, customs clearance).

Transfer of risk: under European consumer law, the risk of loss or damage is transferred to the Buyer only when the Buyer (or a third party designated by them, other than the carrier) physically takes possession of the products.

The Buyer is responsible for providing a complete and accurate delivery address. Any additional costs due to an incomplete or incorrect address may be charged to the Buyer.

8 – Right of Withdrawal (EU Consumers)

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Buyer has a 14-day withdrawal period from the date of receipt of the goods, without having to provide a reason.

Notification: send an email to hello@wanakomeclothing.fr indicating the order number and items concerned. A model withdrawal form can be provided upon request.

Returns: products must be returned within 14 days of notification, in new, unworn, unwashed condition, with original tags and packaging, to:

Return shipping costs are borne by the Buyer. The parcel must be clearly labeled: “Returned goods – no commercial value – customer return” to avoid re-import duties. Any duties or taxes charged upon return may be deducted from the refund.

Refunds: issued within 14 days of receiving the returned items or proof of shipment (whichever occurs first), using the original payment method. The initial standard delivery cost will be refunded; express or additional delivery options are not refundable.

9 – Legal Guarantees

Products benefit from the following legal guarantees:

  • Legal guarantee of conformity (Articles L.217-4 to L.217-14 of the French Consumer Code): in the event of non-conformity, the Buyer may request repair or replacement of the product, or, failing that, a price reduction or contract cancellation, at no cost.
  • Guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code): if a hidden defect renders the item unfit for its intended use or significantly diminishes its value, the Buyer may request a refund or price reduction.

In case of non-conformity or defect, contact: hello@wanakomeclothing.fr (photos may be requested). An appropriate solution will be provided, and reasonable return shipping costs will be reimbursed upon proof if a defect is confirmed.

10 – Liability

Wanakome shall not be held liable for delays or failures resulting from force majeure or unforeseeable, unavoidable events caused by third parties. Except where required by law, the Seller’s liability is limited to the total amount of the order concerned.

11 – Personal Data

Data collected (identity, contact details, address, payment information, order history) are necessary for order management and delivery. They are processed in compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the privacy policy available on the website.

Data may be transferred to Canada, recognized by the European Commission as providing an adequate level of protection for personal data processed by private-sector organizations under the Canadian PIPEDA law.

Rights of access, rectification, deletion, objection, restriction, and portability can be exercised by contacting hello@wanakomeclothing.fr.

12 – Intellectual Property

All elements of the website (texts, images, logos, trademarks, layout, design) are protected by applicable laws and remain the property of Wanakome or its partners. Any reproduction, distribution, or adaptation without prior written authorization is prohibited.

13 – Governing Law and Disputes

These Terms are governed by French law, without prejudice to mandatory consumer protection provisions applicable in the Buyer’s EU country of residence.

In the event of a dispute, the Buyer may use the European Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr or bring the matter before the competent French courts.
